1. HOW IT WORKS: Submit an original color photo of your baby's FACE (age's birth to 2 years old) to qualify for the weekly random drawing.

1. Photo should clearly highlight just baby's face
2. The photo must not contain artwork created by the entrant nor display any commercial/corporate advertising
3. The photo must be in color
4. Photos must NOT contain or depict anything in a manner that is inappropriate
5. Sponsor (Kids II, Inc.) is the sole determinant of appropriate photography

2. GENERAL CONDITIONS: Participants agree (a) that Sponsor, its affiliated companies, advertising and Giveaway agencies, and all of their respective officers, directors, employees, representatives and agents (all of whom are referred to collectively as the "Parties") are released, will have no liability whatsoever for, and shall be held harmless by participants against any liability for any injuries, losses or damages of any kind to person(s), including death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in this Giveaway or any Giveaway related activities and (b) except where legally prohibited, Giveaway recipients grant (and agree to confirm that grant in writing) permission to Sponsor and those acting under its authority the right to the use of his/her name, picture, likeness, voice, biographical information and statements, at any time or times, for advertising, trade, publicity and Giveaway purposes, without additional compensation, in all media now known or hereafter discovered, worldwide, on the Internet and World Wide Web, without notice, review or approval. If a prize notification or prize is returned as non-deliverable, or if a Giveaway recipient is found to be ineligible or otherwise not in compliance with these Official Rules, Giveaway will be forfeited and an alternate recipient selected. 3. ELIGIBILITY: Entry into this Giveaway promotion is open only to legal residents of our Bright Starts™ online shipping area who are parents or legal guardians of a baby between the ages of birth to 2 years old. Employees, officers and directors of Sponsor, affiliated companies, advertising, Giveaway, or production agencies, web masters/suppliers, and any other coordinating agencies involved in the development, implementation, and distribution of the Giveaway (and their legal dependents, immediate family members [spouse, parents, children, siblings] and individuals residing in their same household, whether or not related), are not eligible to participate. By participating, entrants agree to these Official Rules. Void where prohibited by applicable law.

2. Take an original color photo of your baby's face and complete the photo submission form 12:00 a.m. (midnight) Eastern Standard Time (EST) on 7/1/08 and ends at 11:59:59 p.m. EST on 7/31/08 (the "Giveaway Period"). Visit www.brightstarts.com, click on the Gellin' Pal™ Teether Giveaway ad and follow the photo submission instructions. Entry periods begin each Tuesday during the month of July.



3. Entries become the property of Sponsor.

1. All entries must be uploaded and received on www.brightstarts.com within the entry periods to be eligible. Entries received before or after these periods will not be accepted.



2. ALL ENTRIES MUST BE YOUR OWN ORIGINAL UNPUBLISHED WORK AND CANNOT CONTAIN, INCORPORATE OR REFERENCE ANYTHING THAT IS OWNED BY ANY THIRD PARTY OR ENTITY OR WOULD REQUIRE THE CONSENT OF ANY THIRD PARTY OR ENTITY IN ANY JURISDICTION, including, but not limited to, commercial or corporate advertising (corporate logos, brand names, trademarks, slogans, and/or political, personal and religious statements) as determined by Sponsor, in its sole discretion.



3. ONLY PHOTOS THAT MEET THESE CRITERIA WILL BE INCLUDED IN THE CONTEST:



1. Entrant must be parents or legal guardians of a baby between the ages of birth to 2 years old.



2. By entering a photo of your baby, Entrant agrees that photo may be posted online at www.brightstarts.com. Not all photo submissions will be posted. If Sponsor deems that the photo submission does not comply with the Official Rules of the Giveaway, Entrant's photo will not appear on www.britghtstarts.com or be eligible to participate in the Giveaway.


4. You may enter one baby photo (one per child if more than one child) each week during the five (5) entry periods.



5. Photos and statements must meet the additional Guidelines below.

5. Sponsor is the sole determinant of appropriate photography
6. Entrant must be parents or legal guardians of a baby between the ages of birth to 2 years old
7. The photo must be in JPG format
8. The photo cannot have been submitted previously in a contest of any kind or exhibited or displayed publicly through any means previously

6. GIVEAWAY RANDOM DRAWING: Winners will be selected in random drawings held on/or about the Wednesday following the close of an entry period from all eligible entries received for that drawing. Decisions are final and binding in all matters relating to this Giveaway. Recipients will receive their free Gellin' Pal™ Teether via USPS. Entries for any week's drawing may be carried forward to subsequent drawings. Entries that may be carried over do not include recipients of the Giveaway from previous periods. No substitution, cash redemption or transfer of prizes is allowed.

7. GIVEAWAY PRIZE/ODDS OF WINNING: Odds of winning for any week are dependent upon the number of eligible entries received by Bright Starts™ for that week. No purchase is necessary to enter this Giveaway and making a purchase does not increase your odds of winning a prize in this Giveaway.

8. RIGHT TO USE SUBMISSION AND INFORMATION: Entries and all other submitted material become the property of Sponsor and will not be returned. By submitting an entry: (a) you irrevocably assign to Sponsor all rights, title, copyright and interest in your entry in any and all media whether now known or hereafter devised, in perpetuity, anywhere in the world, with the right to make any and all uses thereof, including, without limitation, for purposes of advertising or trade. The rights granted under this paragraph shall extend to all entries and all other submitted materials related to the Giveaway promotion, including those submitted by non-winners and winners. ENTRANTS RELINQUISH ALL RIGHTS TO ANY SUBMITTED MATERIAL. By submitting an entry, you grant to Sponsor and its affiliated companies, the right, except where prohibited by law, to use your name, likeness, picture, address (city and state), email address, voice, biographical information and written or oral statements, for advertising and promotional purposes in promoting or publicizing Sponsor and its products or services, without compensation unless required by law. You shall have no right of approval, no claim to compensation, and no claim arising out of any use or use in composite form of your information and/or submission. The rights granted under this paragraph shall extend to Sponsor and its affiliated companies with respect to all entrants in the Giveaway, including non-recipients and recipients.

Submissions, as solely determined by Sponsor, must not display unsafe practices or placement of baby; must not contain defamatory words/statements; they must not include threats; they must not disparage or invade privacy or other rights, and they must not in any other way contain material that is unlawful, in violation of or contrary to all applicable federal, state, or local laws and regulations, or the laws and regulations in any state where photograph is taken. Submissions may not contain material that is inappropriate or indecent. The submission must not contain material that violates or infringes another's rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement.

9. LIABILITY LIMITATIONS: The Sponsor, and its respective agencies are not responsible for lost, late, illegible, misdirected, incomplete, non-delivered mail, entries or email; or for interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), website, telephone or other connections, availability or accessibility, or miscommunications, or failed computer, satellite, telephone or cable transmissions, or lines, or technical failure or jumbled, corrupted, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures, or technical errors or difficulties, or other errors of any kind whether human, mechanical, electronic or network or the incorrect or inaccurate capture of user ID/password or entry or other information or the failure to capture, or loss of, any such information. Persons who tamper with or abuse any aspect of this Giveaway, as solely determined by the Sponsor, will be disqualified. Any use of robotic, automatic, macro, programmed or like entry methods will void all such entries by such methods, and disqualify any entrant using such methods. Neither Sponsor nor the Parties are responsible for injury or damage to participant's or to any other person's computer related to or resulting from participating in this Giveaway or downloading materials from or use of the website. Should any portion of the Giveaway be, in Sponsor's sole opinion, compromised by virus, worms, bugs, non-authorized human intervention, technical failures or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Giveaway, and select the winners from entries received prior to action taken or as otherwise deemed fair and appropriate by the Sponsor. Neither Sponsor nor its respective agencies are responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Giveaway, and assume no responsibility for any error, interruption, deletion, defect, delay in operation, or transmission, communications line failure, theft or destruction, or unauthorized use to this website. In case of dispute, the authorized subscriber of the email account used to enter the Giveaway at the actual time of entry will be deemed to be the participant, and must comply with these Official Rules. You and Kids II irrevocably consent to the exclusive jurisdiction of any state or federal court having jurisdiction located in Georgia in connection with any action arising out of or related to these official rules or their subject matter and waive any objection based on lack of personal jurisdiction, place of residence, improper venue or forum non-convenience in any such action.
